The following describes the terms on which Click E-Deals offers you access to our services. including Click-E-Deals.com and its subdomains, Click-e-Bids, and any related sites or services, you (“the user”) agree to the terms of use set forth in this agreement, as well as our Privacy Policy (which is published at http://www.clickedeals.com/privacy_policy and incorporated here by reference). If, upon fully reading this agreement, you do not wish to comply with the terms of use, exit from and refrain from returning to any and all sites owned and operated by Click E-Deals. If the user proceeds to engage with Click E-Deals services after a compete review of this agreement, it is considered full consent to the terms of use agreement and our privacy policy. In addition, said user certifies they are 18 years of age or older. In addition, said user certifies they are 18 years of age or older. Individuals under the age of 18 may not use services offered by Click E-Deals.

Click E-Deals grants you a limited, personal, nontransferable, revocable license to access and use this website(s) only as expressly permitted in this Agreement. Except for this limited license, we do not grant you any other rights or license with respect to this website(s); any rights or license not expressly granted herein are reserved.
By accepting these terms of use you agree that this User Agreement and the Click E-Deals Privacy Policy will apply whenever you use the Click E-Deals or Click-e-Bids websites and their services. Additional and future Click E-Deals websites may have additional or alternate Terms of Use and you further agree to fully review any such additions or alterations.
Click E-Deals maintains the right to change or discontinue any content, tool, or feature of any Click E-Deals sites. Examples, although not limited, may include hours of live access, equipment needed for access or use, or basic content updates and revisions. Click E-Deals may also discontinue disseminating any portion of information or category of information, may change or eliminate any transmission method and may change transmission speeds or other signal characteristics.
End User acknowledges that the Internet and use of the Internet has, although limited, an inherent risk of interruptions in service and other events that are beyond the control of Click E-Deals or its entities. This risk lies on the end user and therefore is not the responsibility of Click E-Deals and we are not liable for lost or damaged data transmitted via the Internet.
Modifications to User Agreement and Terms of Service
Click E-Deals retains all rights to discontinue or modify User Agreement and/or Terms of Use as necessary to conduct business and act in accordance to all current Federal, State, and local laws. Such changes may include, among other things, the adding of certain fees or charges. Should any substantial changes be required End Users will be notified via e-mail to the e-mail address that is registered with End User’s account and/or by posting notice of the change on the website(s).
All changes will be effective once e-mail notices have been sent or have been posted on Click E-Dealswebsite(s). Vouchers from Click e-Bids purchased prior to the effective date of such changes will not be impacted by said changes. These changes will be effective immediately for new users and any Vouchers purchased on Click e-Bids by such new users. End Users should periodically review User Agreement, Terms of Service and Privacy Policy to stay informed of any modifications. Any use of the website(s) by End User after such notice shall be deemed to constitute acceptance by End User of such modifications.
Terms of Sales on Vouchers purchased on Click E-Deals and Click e-Bids
All Vouchers obtained from Click E-Deals and Click e-Bids sites are promotional vouchers that may be purchased from participating Merchants through Click E-Deals or Click-e-Bids to be used in exchange for goods and services at a discount from their actual retail price. By placing an order or bid for a Voucher from a Merchant through the Click E-Deals and Click e-Bids websites, the End User is making an offer to purchase the Vouchers on the terms and conditions stated below. For more information about our collection of personal information, please view our Privacy Policy. All End Users are required to create an account in order to purchase or bid on any Voucher on Click E Deals and Click e-Bids. This is required to provide you easy access to print orders, view your past purchases, indicate preferences, and to ensure legal use of the Voucher.
Terms of Vouchers on Click E-Deals and Click e-Bids
All Vouchers shall be subject to the terms and conditions of Click E-Deals and Click e-Bids and participating Merchants or Restaurants. The “Merchant” or “Restaurant” is the seller of the goods or services being purchased by End Users. The issuing entity of a Restaurant-Specific Voucher is the Restaurant. The issuing entity of a Merchant Voucher is the Merchant. As the issuing entity of the Voucher, the Restaurant or Merchant shall be fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by, or in the respect of a customer, caused in whole or in part by the Restaurant or the Merchant, as well as for any unclaimed property liability arising from unredeemed Vouchers or portions thereof.
Terms of Service Specific to Click e-Bids Auctions
Users of Click E-Deals and Click e-Bids services and websites are explicitly prohibited from and shall not:
End Users release Click E-Deals and Click e-Bids and all its entities, officers, directors, employees and agents from, any claim, liabilities, damages, or injuries related to any act or omission of Merchant or Restaurant regarding a Voucher or the services/goods provided as it relates to compliance with applicable unclaimed property and other laws relating to the redemption of the Vouchers or any portion thereof. Restaurant-Specific Vouchers and Merchant Vouchers are redeemable in their entirety and on a one-time basis only and may not be redeemed incrementally.
The expiration date on the Voucher dictates the last date that the Voucher may be redeemed at Merchant or Restaurant for the promotional offer stated on Click E-Dealsand Click e-Bids websites. According to applicable law, the Merchant may be additionally responsible for allowing End Users to redeem a Voucher for the cash value based on the money actually paid for that said Voucher to the Merchant or Restaurant and not the redeemable value, for a period of time that extends beyond the expiration date on the Voucher.Original proof of purchase receipt may be required by merchant or restaurant. Please check your respective state law and regulations for needed details.
If End User has an expired Voucher from merchant purchase through the Click e-Bids auction website and would like to redeem it for the original purchase price paid to the merchant, End User should contact the Merchant directly.
Click E-Deals and Click E Bids, and all its entities, officers, directors, employees and agents are not responsible for any refund, refund policies, or final redemption of merchant or restaurant offers of voucher. Click E-Deals and Click e-Bids and all its entities, officers, directors, employees and agentsare not involved whatsoever with the particular merchant coupon value, a voucher or the merchant’s respective redemption policies.
End User Equipment Requirements
End User shall be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of this Site and all charges related thereto. Click E-Deals, Click e-Bidsandall its entities,officers, directors, employees and agentsshall not be held liable for any damages to the End User’s equipment resulting from the use of Click E-Dealswebsites.
Your sole and exclusive remedy for disputes with any Click E-Deals or Click e-Bidsproducts or services is to discontinue your use of these products or services. In no events shall our liability or the liability of our affiliates, officers, directors, agents, vendors, or merchants for any and all claims relations to the use of the website(s) and products and services shall exceed the total amount of fees that you paid for the products and services. Original proof of purchase payment receipts for products and services on Click E-Deals and Click e-Bidsare necessary and required for any dispute brought forward by the user. We, our affiliates, officers, directors, agents, vendors, and merchants shall not be liable for any indirect, special, incidental, consequential or exemplary damages arising from your use of, inability to use, or reliance upon the site and services. These exclusions apply to any claims for lost profits, lost data, loss of goodwill, work stoppage, computer failure or malfunction or any other commercial damages or losses even if we knew or should have known of the possibility of such damages. If any jurisdiction does not allow all of the exclusions or the limitation of liability for consequential or incidental damages, in such jurisdiction, our liability, and the liability of our affiliates, officers, directors, agents, vendors, or merchants shall be limited to the full extent permitted by law.
By your use of the Click E-Deals and Click e-Bids websites you agree to defend, indemnify and hold harmless Click E-Deals and Click e-Bids, its websites and services, all its entities, our affiliates, officers, directors, agents, dealers, vendors, or merchants, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to reasonable attorney's fees) arising from: (i) your use of and access to our sites and services; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that any Content submitted by you causes damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of Click E-Deals and Click e-Bids websites and services.
